Louisiana Appeals Court Finds Environmental Justice Is Part of the Louisiana Public Trust Duty

On January 19, 2024, the Louisiana First Circuit Court of Appeal reinstated the Formosa Plastics (“FG LA”) facility air permits, which the lower court had previously vacated. Louisiana Department of Environmental Quality , 2023-CA-0578. They also indicated that the emissions were comparable to state averages.
