While it “began public preparations” to apply to FERC for renewal in late 1999, DWR has yet to obtain a new license and operates under annual interim licenses to this very day. DWR’s license to operate the Oroville facilities was issued in 1957 for a 50-year term set to expire in 2007.

FERC was preparing its own environmental impact statement under NEPA at the same time.) DWR’s activities weren’t limited to the relicensing. It was also undertaking environmental review under CEQA by preparing an EIR for the project. Finally, in 2008, DWR approved the settlement agreement and certified the EIR.
