A couple years ago , I detailed how an industry designed to increase and sell devices tampering with pollution controls was trying to use the extremely small slice of its business targeted at racing as a Trojan horse to hinder EPA enforcement and let loose a bevy of tampering devices on the American public. While the agency has failed to update the rule as required under the Clean Air Act, last year, EPA identified 23 “elevated cancer risk” commercial sterilizers and is currently working to inform communities and work with state regulators and the facilities to decrease emissions. But much more is needed. What can be done?

This level of forced retirements is far in excess of any prior EPA projections of plant shutdowns resulting from implementation of a Clean Air Act rulemaking. For example, EPA projected a total of just 4,700 MW of coal capacity retirements under the 2012 Mercury and Air Toxics Standards rule.
