The Clean Air Act requires the EPA to review—and update—its ethylene oxide emissions standards every eight years, but the last time it did so was in 2006. In 2016, it concluded that the gas is 60 times more toxic than its previous estimate. However, the EPA does caution that children may be more susceptible.

The state of Minnesota uses EPA’s ethylene oxide emissions standards, which haven’t been updated since 2006. EPA’s own scientists concluded in 2016 that the risk value of ethylene oxide is 60 times more toxic than previously understood. You can call or write letters to state regulators voicing your concern on this issue.

Circuit also rejected EPA’s argument that the court did not have authority to review stays issued under Section 307(d)(7)(D) of the Clean Air Act. Circuit concluded that EPA had acted arbitrarily and capriciously in determining that the four elements of the regulations that had been stayed met these requirements.
