Ontario’s (once) Promising Endangered Species Act Ontario was the first province in the country to pass an Endangered Species Act in 1971.

For example, the Redside Dace and Butternut are just two of many species at risk that would be impacted by the proposed giant Highway 413.

This case marks the first time the Ontario Court of Appeal will consider the meaning of “damage” to habitat under Section 10 of the ESA, which makes it an offence to damage or destroy an endangered or threatened species’ habitat.
