In late December, the Treasury Department and the Internal Revenue Service (IRS) released proposed regulations for the Section 45V Clean Hydrogen Production Tax Credit. Today, hydrogen is overwhelmingly produced through a heavily polluting fossil fuel-based process. It is a climate problem, not a climate solution.

The CI is determined through a lifecycle analysis of the global warming pollution associated with the production and use of gasoline, diesel, biofuels, electricity, or other alternative fuels. The lower stringency results in lower costs and reduced economic impact of the regulation. Unfortunately, this is far from the truth.

Homer City based its decision on several factors including the low price of natural gas, a dramatic spike in the cost of its ongoing coal supply, unseasonably warm winters and increasingly stringent environmental regulations.
