State of Montana, a Montana trial court ruled that the state Constitution’s guarantee of a healthy and clean environment prevails over Montana’s longstanding fossil-fuel-based state energy system. Judge Seeley did so after presiding over a two-week, non-jury trial in June 2023–the first such climate change trial in U.S.

Status of Wind Energy in the Gulf of Mexico. Interior’s authority to regulate offshore wind comes from the Energy Policy Act of 2005, which amended the Outer Continental Shelf Lands Act to expressly authorize Interior to issue leases for renewable energy projects in federal waters. 585.107(a).
