Summary

This Comment examines how various limits on the availability of citizen suits have impeded their role in remedying environmental injustice under the Clean Air Act (CAA). Part III explains the regulatory
framework of the CAA and its citizen suit provision.39 Part IV explores the structural, procedural, and practical limitations that affect the ability of those impacted by environmental injustice to bring citizen suits. Finally, Part V suggests various types of reforms available to address these limitations and explores the Biden Administration’s efforts to remedy environmental injustice through CAA enforcement.
