Pfaffenroth Quoted in Global Competition Review on Policy Statement Revocation

Antitrust partner Sonia Pfaffenroth was quoted in the Global Competition Review article, "Practitioners sceptical about 'sudden' DOJ policy statement withdrawals." The story discusses the revocation by the Antitrust Division of the Department of Justice of three long-standing policy statements relating to enforcement in healthcare markets that provided for "safety zones" within which healthcare companies could share sensitive information. However, the DOJ now describes these policies as outdated and not reflective of current market realities.

Pfaffenroth said the DOJ's revocation of these policies has "implications far beyond the healthcare industry for companies that have relied on the 'safe harbours' to guide compliance." Pfaffenroth also noted that investigations and enforcement around exchanging information would likely increase.
