On May 21, 2024, the International Tribunal for the Law of the Sea (ITLOS) delivered a long-awaited Advisory Opinion on climate change and international law. This marks the first time that an international tribunal has issued an advisory opinion on State obligations regarding climate change mitigation.

Of course, these adjectives have also been used to describe many other recent judgments delivered on the topic of climate change. Still, there is something in this advisory opinion that—although not changing the world— could be impactful. However, these treaties seem to have had little bearing on ITLOS’ interpretation of UNCLOS.

Despite the ongoing debate on whether ITLOS has jurisdiction to issue an advisory opinion on climate change, if the Tribunal asserts jurisdiction (on jurisdiction, see here and here) , there is still much to uncover. However, ITLOS is not responsible for implementing the UNFCCC or the Paris Agreement.
