We thought that the key to reducing air pollution was to require better pollution control devices. Conventional pollution controls would have been seen as transition measures until the shift to clean energy, so the Clean Air Act would have been written differently.

Through the Clean Air Act , and as affirmed—and reaffirmed—through multiple legal sagas, EPA is statutorily obligated to address carbon pollution from fossil fuel-fired power plants.

In 2019, EPA issued the Affordable Clean Energy rule , repealing the Clean Power Plan on the basis that EPA only had the narrow authority to base standards on technologies that could be applied directly “to or at” individual power plants, rather than strategies that involve broader shifts in power sources (so-called “beyond the fenceline” measures).
