The court held that BLM and FWS could lawfully exclude GHGs from their ESA jeopardy analysis because the emissions were not “reasonably certain” to “effect listed species or critical habitat” in the “Action Area” and thus did not qualify as “effects” within the meaning of the ESA. The Opening session provided a recap and an update of the status of various policy statements and working papers being managed for decision by the UNFCCC. YEAH involved ESA in a number of events today, and Gillian and Pam served as very useful guides to navigate COP. ESA also had a poster exhibited in the Just Nort Pavilion.

The Ninth Circuit Court of Appeals reversed a district court decision that vacated the listing of the Beringia distinct population segment (DPS) of the Pacific bearded seal subspecies as “threatened” under the Endangered Species Act (ESA). The court also cited “anticipatory” remarks made by Healey about the ExxonMobil investigation.
