The history of these pollution standards is quite distinctive. Tier 3 standards were phased in starting with 2017 cars.

In 2016, the Supreme Court took the unprecedented step of staying the rule while the DC Circuit Court of Appeals considered a challenge by conservative states and coal companies, and the Trump Administration took office in 2017 before the DC Circuit issued an opinion. The court then paused the litigation while EPA revisited the issue.

On September 14, the Clean Air Council appealed an effort by Pennsylvania to resurrect a defunct air pollution control permit that would allow construction of a large gas-fired power plant proposed for Robinson Township. The result is that Robinson Power has no valid permit to build the power plant at all.
